Welcome to Daily Plan by NIIVIIN (“the App,” “Service,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Daily Plan progressive web app and related services operated by NIIVIIN.
Please read these Terms carefully before using the App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please discontinue use of the App.
1. Overview:
Daily Plan by NIIVIIN is a free digital planning tool designed to help users organize their day, manage appointments, track habits, and promote mindfulness. The App may store limited user information such as name and email to allow account creation and personalized access.
2. Acceptance of Terms:
By using the App, you agree to comply with these Terms and any future modifications. NIIVIIN may update these Terms periodically, and continued use of the App after changes are posted constitutes acceptance of the revised Terms.
3. Eligibility:
The App is available to individuals of all ages. However, users under 13 should only use the App with the consent of a parent or guardian.
4. Accounts and Security:
To access certain features, you may be required to create an account using your name and email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

5. Use of the Service:
You agree to use the App only for lawful purposes. You may not:
- Copy, modify, or distribute any part of the App without authorization.
- Attempt to reverse-engineer, hack, or interfere with the App’s functionality or servers.
- Upload harmful code, spam, or abusive content.
NIIVIIN reserves the right to suspend or terminate accounts violating these Terms.
6. User Content:
You may input personal notes, goals, or daily journal entries into the App (“User Content”). You retain ownership of your User Content, but by inputting data in the App, you grant NIIVIIN a limited, non-exclusive right to store saved data solely for the purpose of operating the Service. NIIVIIN does not review or claim ownership over User Content, and such data is stored only for your use within the App. However, NIIVIIN may remove content that violates applicable laws or these Terms.
7. Data and Privacy:
The App collects minimal personal data (name and email) required for account access. This data is never sold or shared with third parties except as necessary to provide or improve the Service. You acknowledge that NIIVIIN may collect non-identifiable technical data (such as browser type or app usage) to enhance performance and reliability.

8. Intellectual Property:
All design elements, code, graphics, trademarks, and content within the App (excluding User Content) are the intellectual property of NIIVIIN and are protected by copyright and trademark laws. You may not use, copy, reproduce, or exploit any NIIVIIN intellectual property without written consent.
9. Disclaimer:
Daily Plan by NIIVIIN is intended for general organizational and motivational use only.
While the App may help individuals with ADHD reduce cognitive load and improve focus, NIIVIIN makes no medical claims that the App can diagnose, treat, cure, or prevent ADHD or any medical condition.
Users should consult a qualified healthcare provider for any medical or mental health concerns. The App is provided “as is” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement.
10. Limitation of Liability:
To the fullest extent permitted by law, NIIVIIN shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of or inability to use the App. Your sole remedy for dissatisfaction with the App is to discontinue use.
11. Indemnification:
You agree to indemnify and hold harmless NIIVIIN, its affiliates, employees, and partners from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
12. Termination:
NIIVIIN may suspend or terminate your account and access to the App at any time if we reasonably believe you have violated these Terms or used the Service unlawfully.
You may stop using the App at any time by deleting your account.
13. Governing Law:
These Terms shall be governed by and interpreted according to the laws of the State of Florida, United States, without regard to conflict of law principles.
Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.
